Commercial Lessor did not waive her claim for possession by accepting a rent check from lessee where lessor did not cash or deposit lessee’s check, and lessor did not express or imply the voluntary relinquishment of her right to her possession of the premises. The appellate Court reversed the Trial Courts granting the tenants motion to dismiss. Mr. Ring represented the landlord/appellant.
